Terms of use on barter.expert

These terms are a public offer in accordance with the provisions of the current legislation of Ukraine. The User registration on the online platform Barter.expert is considered an unconditional acceptance of all provisions of these Terms of Use, as well as the Privacy Policy. In case any part of these Terms of Use is deemed invalid or unenforceable, the remaining parts shall remain valid.

The Terms of Use establish the general rules for creating a User profile, creating products or services for barter, exchange, auction, buy/sell on Barter.expert.

If you, as a User, do not agree with these Terms of Use, you must not use Barter.expert. We recommend that you periodically review these Terms of Use, as continued use of Barter.expert constitutes your acceptance of all changes made to them from the moment they are introduced.

1. General requirements.

1.1. The publication of information on the online platform Barter.expert must fully comply with the requirements of the current legislation of Ukraine.

1.2. The User guarantees that the products or services they create comply with the information specified in the name and description of the product or service, are free from third-party claims, and that their posting does not violate intellectual property rights.

1.3. By creating products or services that require mandatory certification in Ukraine, or in licensed activities, the User is responsible for ensuring that they possess the necessary permits and documentation.

1.4. A product or service will be considered prohibited not only if it contains prohibited information in its name or description but also if it includes such content in its images or tags.

1.5. To prevent fraudulent activities on the online platform Barter.expert, all Users are prohibited from adding any phone number to the name, description, or tags of their product or service. Any products or services that violate this rule will be rejected during moderation. On the User's product or service page, their contact information (name and phone number) provided during registration will be automatically displayed. If the User does not want their contact information (name and phone number) to be displayed on their product or service page, they need to go to their profile, select the appropriate setting, and update their profile.

1.6. If there are reasonable suspicions that a product or service contains information about prohibited products or services, or encourages illegal activities, the administration of Barter.expert has the right to block access to such information without prior notice.

1.7. If the administration of the online platform Barter.expert detects any information related to products or services that are prohibited from publication according to these Terms of Use or the legislation of Ukraine, the product or service will be automatically blocked without prior notice.

2. Content of the Terms of Use.

2.1. The administration of the online platform Barter.expert has the right to fully or partially restrict access to information if it contains:

information about other Users (both legal and natural persons), materials containing state and banking secrets;
information that infringes upon third-party intellectual property rights (such as copyright, trademarks, patent rights, trade secrets, etc.), including the use of trademarks, images, texts, and other content without the consent of the copyright owner (author);
information that violates personal (non-property) rights, including content that infringes upon the inviolability of private life, or insults the honor, dignity, or business reputation of individuals or legal entities;
materials that contain unfounded accusations against a person or company, as well as defamation or threats;
information that contains elements of cruelty, violence, pornography, cynicism, or the degradation of human honor and dignity;
images of 18+ products resembling intimate body parts;
images of partially or fully exposed intimate body parts;
images of men/women demonstrating the use of 18+ products;
the use of profanity, vulgar, and offensive expressions;
information aimed at providing sexual services (including stripping, erotic massages, etc.) and human trafficking;
calls for protests, strikes, violence, and unlawful actions, as well as the promotion of hatred, violence, discrimination, racism, xenophobia, and inter-ethnic conflicts;
information about methods of deception and fraud, abuse of trust, as well as methods for violating or circumventing current legislation;
description or image of sexual relations, and the verbal description of intimate body parts in a vulgar form;
unethical and false information;
information that promotes: war, national and religious hostility, changing the constitutional order or territorial integrity of Ukraine through violence, fascism and neo-fascism, or that humiliates or offends a nation or individual based on nationality;
any other information that violates the legislation of Ukraine and these Terms of Use;

2.2. It is prohibited to create products or services that contain:

alcoholic products;
equipment, including moonshine stills, for producing moonshine and other homemade strong alcoholic beverages;
alcohol, including ethyl alcohol, brandy, fruit spirits, etc.;
services related to the manufacture, production, cultivation, storage, transportation, import, and export of narcotic substances, psychotropic substances, as well as plants, preparations containing such substances and their analogs;
narcotic substances, psychotropic substances included in the list approved by the Cabinet of Ministers of Ukraine, as well as their analogs (such as sibutramine, phentermine, phenylnitropropene, nitroethane, and others);
plants and plant-based objects, as well as plant-based objects and seeds containing narcotic, psychotropic, hallucinogenic, or toxic substances (such as cannabis, marijuana, hemp, etc.);
devices and accessories for consuming narcotic and psychotropic substances, as well as for consuming and cultivating plants that contain them (such as bongs, pipes, water pipes, grinders, etc.);
tobacco products, smoking mixtures (including cigarettes, cigars, sticks for tobacco heating devices, hookah smoking mixtures, ready-to-use e-cigarettes, any liquids (including base for liquid production), cartridges for e-cigarettes, vapes, and other smoking devices, other products made from tobacco or its substitutes);
poaching equipment for obtaining wildlife objects: electrofishing systems and other fishing tools, traps;
representatives of flora and fauna included in the Red Book, any wild animals, as well as animal skins, leather products, horns, limbs, and stuffed animals from such creatures;
proposals for online work for girls (web models), escort services, etc.;
services related to gambling systems, casinos, betting, and any other information about the gaming business;
products with supernatural characteristics that are capable of influencing the spiritual world, property, or well-being, etc.;
services of fortune tellers, psychics, hypnotists, seers, astrologers, witches, and others who claim to or are considered capable of predicting events, influencing people, the spiritual world, or property;
human organs, tissues, cells, and other anatomical materials (including, but not limited to: donor blood and its components), donor services;
identification documents (passports, ID cards, driver's licenses, student IDs, etc.), documents of strict reporting, as well as other documents and forms with special technical and holographic protection;
services related to the issuance of passports, identity cards, and other documents, whose issuance is within the jurisdiction of governmental bodies and institutions;
databases and records containing personal data, including phone numbers, email addresses, etc.;
any weapons, key components of weapons, ammunition, including:
- firearms, hunting rifles and smoothbore guns;
- strike-blunt cold weapons (knuckles, clubs, maces, nunchucks, etc.);
- throwing cold weapons (including throwing knives, shurikens, slingshots with a blade or metal striking element that meets the characteristics of bladed and combined cold weapons), crossbows and bows with a string tension force greater than 20 kg and a metal striking element, as well as bladed and combined cold weapons (knives, knuckle-knives, etc., with a blade length greater than 90 mm, thickness greater than 2.6 mm, and a blade sharpening angle of less than 30 degrees). Products not marked as prohibited in this section are allowed to be published on Barter.expert only if the term "weapon" is not included in the product's name, description, or tags, and if there are legal documents authorizing their use;
souvenir and/or other products bearing the symbols of the Russian Federation, the communist totalitarian regime, the symbols of the National Socialist (Nazi) totalitarian regime, the symbols of Russian imperialist politics, and symbols of self-proclaimed states not recognized by Ukraine;
contain images of individuals and/or are the result of creative and other activities of individuals who justify, consider legitimate, support, or deny the armed aggression of the Russian Federation against Ukraine;
contain justifications, recognition as legitimate, or denial of the armed aggression of the Russian Federation against Ukraine, including by presenting the armed aggression of the Russian Federation against Ukraine as an internal conflict, civil conflict, or civil war, as well as denying the temporary occupation of parts of the territory of Ukraine;
products from the Russian Federation;
products that bear trademarks under which the products are registered and belong to companies whose owners are citizens of the Russian Federation;
state awards, orders, medals, badges of honorary titles, and badges of state prize laureates, excluding their copies;
counterfeit currency and counterfeit postage stamps, as well as postage stamps that are in circulation without the seller having an agreement with the national postal operator for the sale of such stamps;
foreign currency and other monetary valuables (except for the buying and selling of coins and banknotes for numismatic purposes), stocks, and other securities belonging to third parties;
services for the buying and selling of currency and cryptocurrency, lending, providing loans, repaying loans, pawnshop services, money transfers, and account/top-up services;
explosive substances and particularly dangerous chemicals (such as gunpowder, dynamite, TNT, nitroglycerin, etc.);
pyrotechnic products for technical and special purposes;
products whose sale and/or use violate the foundations of law and order, do not align with the principles of public morality and/or decency;
products whose use poses potential dangers when operating vehicles (such as seat belt stoppers and airbag cover decoys);
special means of active self-defense, protective or mobility-restricting equipment used by law enforcement agencies, as well as products with concealed elements of traumatic impact (such as batons, stun devices, tactical pens, handcuffs, pepper sprays, gas pistols, vehicle immobilization devices, devices with sound, light, acoustic, or microwave effects, items equipped with smoke-generating substances, kubotans, yawaras, etc.);
special-purpose search equipment (mine detectors, military-use metal detectors) used by certain specialties of the Armed Forces of Ukraine and police officers involved in demeaning operations;
special individual protective equipment (helmets, body armor, armor plates, etc.);
suspicious job offers, including those online, without specifying a physical address or direct employer contacts;
vehicles without documents or those that are listed as stolen;
ready-made vehicle license plates, flipping frames (curtain systems for license plates), and other items that allow concealing/masking/making a vehicle's license plate partially invisible, including during photo enforcement of traffic violations;
veterinary drugs that have not been registered in accordance with the established procedure in Ukraine;
dietary supplements (including food, sports, and those for potency/libido, etc.) without an international certificate or other documentation from the country of origin confirming their quality and/or the conclusion of an authorized body (e.g., SES of Ukraine) on the safety and quality of the product, as well as its status as a "dietary supplement";
pharmaceuticals and medicines that are restricted in free circulation (including by international competent organizations) and/or are included in the list of prohibited items for advertising, not registered in Ukraine, which are dispensed by prescription (including to individuals under the age of fourteen), such as steroids, peptides, and anabolic substances;
any traditional (non-traditional) medicine products or remedies not registered as medicinal products or dietary supplements in accordance with the current legislation of Ukraine, which lack the necessary supporting documents confirming the quality and safety of such products, as well as preparations containing toxic substances and not registered as medicinal products;
and any other products or services prohibited by the legislation of Ukraine;

3. Responsibility.

3.1. The administration of Barter.expert is not responsible to Users or other third parties regarding:

compliance of the activities carried out by the User in the creation of products or services with the requirements of Ukrainian legislation;
the accuracy, content, legality, and completeness of the information provided/received by the User while using online platform Barter.expert;
the compliance of products or services with the expectations and/or requirements of the User, as well as the quality of products or services provided by the Users;
the fulfillment of the User's obligations regarding the completion of barter, exchange, auction, or buy/sell transactions;

3.2. If third parties, including other Users, make claims against the Owner of Barter.expert related to the User's use of the online platform Barter.expert, the User is obligated to resolve these claims independently and at their own expense, protecting the administration of Barter.expert from any potential losses or legal proceedings. Additionally, the User must reimburse the Owner of Barter.expert (including legal costs) for any losses caused by such claims and lawsuits, which are related to the User's placement of materials, product listings, and/or activities on Barter.expert.

3.3. The administration of Barter.expert shall not be liable under any circumstances to Users or third parties for any indirect damages, including lost profits.

3.4. The administration of Barter.expert does not control the quality or delivery timelines of products or services provided by Users through the placement of corresponding information on Barter.expert. As a result, the User accepts the condition that all products or services offered through Barter.expert by Users are provided at their own responsibility. The User assumes full responsibility and risks for receiving products or services offered by other Users via the placement of the relevant information on Barter.expert.

3.5. All disputes and disagreements between Users regarding products or services received as a result of mutual bartering on Barter.expert must be resolved and handled between the Users themselves.

3.6. The administration of Barter.expert will not be held responsible for any damages or losses that directly or indirectly arise from the activities of Users on Barter.expert.

3.7. The administration of Barter.expert reserves the right to delete or block access to information posted by the User without prior notice in the following cases:

providing false information by the User, engaging in activities that violate the requirements of the current legislation of Ukraine;
receiving mandatory decisions from competent state authorities of Ukraine;
detection of information that is prohibited from being posted on Barter.expert or does not comply with the requirements of these Terms of Use;

4. Intellectual property.

The collection of programs, data, copyright objects, and other items used on Barter.expert constitutes the intellectual property of its lawful owners and is protected by the intellectual property laws of Ukraine, as well as relevant international legal agreements and conventions. Any use of elements, symbols, texts, graphic images, programs, and other objects that are part of the online platform Barter.expert and belong to Barter.expert, without the permission of the Barter.expert administration, is illegal and may result in legal proceedings, as well as civil, administrative, and criminal liability in accordance with the laws of Ukraine.
